Terms and conditions
This is a contract for personal photography services to be provided by ‘Corinna and Dylan’. The client/s agree to the following terms and conditions:
1. CHANGE OF SCHEDULE OR VENUE
‘Corinna and Dylan’ must be notified of any changes in schedule or location at least one week prior to the scheduled date of event. Notification of any changes can be made via email. It is the client’s responsibility to confirm all arrangements at least 7 days prior to the event. In the event of change of address or contact information (time, etc.) as listed, you must contact ‘Corinna and Dylan’ and confirm their availability. In the event of a change of location to an interstate or international wedding all travel & accommodation costs must be covered by the clients.
2. DEPOSIT
A non-refundable deposit fee of $1000.00 is required to hold the date of your event. No date is reserved until a deposit is received. The balance of the complete package price must be paid at least 1 month prior to the event. If final payment is not received, ‘Corinna and Dylan’ will be released from any obligation to carry out the work specified under this contract.
3. COVERAGE
The photographer(s) will provide coverage for the dates, locations, and hours specified in this Agreement to the best of their ability. Hours of coverage are continuous. Every reasonable effort will be made to take requested pictures, but no specific photograph can be guaranteed. Photographer will use his professional judgment and sole discretion to select which photographs to deliver. Additional hours of coverage must be paid in full at the time of order.
4. CANCELLATION
There shall be no refund of deposit after 48 hours from the signing of this agreement. Once the full balance is paid, it is non-refundable. Any other arrangements shall be discussed between the client and ‘Corinna and Dylan’. Cancellation must be in writing even if a phone call was made to inform ‘Corinna and Dylan’ of the cancellation.
5. REST
The photographer(s) is required to be provided with an allocated break time of 20 minutes with every 6 hours worked. This condition also applies to any assistant/s employed under ‘Corinna and Dylan’. Generally, the photographer and assistant/s will join in with the sit down dinner at the reception or cocktail style dinner.
6. FAILURE TO PERFORM
Due to the limited and subjective nature of the event, ‘Corinna and Dylan’ cannot be held responsible for requested photographs not taken or missed, lack of coverage resulting from weather conditions, or schedule complications caused by but not limited to, anyone in or at the event, or by the church or location restrictions. The photographer is not responsible for lost photo opportunities due to other cameras or flashes, the lateness of the bride, groom, or other principles. The Photographer is not responsible for the lack of coverage due to weather conditions, scheduling complications due to lateness of individuals, rules and restrictions of venue, or the rendering of decorations of the location. It is acknowledged that any lists submitted to ‘Corinna and Dylan’ (via hello@corinnaanddylan.com) will be used for organisational purposes only. ‘Corinna and Dylan’ will do its best to fulfil all requests. Clients are responsible for all location fees and permits as required.
7. COPYRIGHT
Title (possession) of and copyright to all products shall remain with ‘Corinna and Dylan’. Once payment has been received for these the client will receive the USB of the final images taken within the designated timeframe and full image reproduction, communication and publishing rights. No un-retouched files will be provided to the clients. ‘Corinna and Dylan’ retains rights to use the finished files for professional samples, displays, internet website pages, advertising, exhibitions, contests and social media.
8. EXCLUSIVE PHOTOGRAPHER
‘Corinna and Dylan’ shall be the exclusive photographer(s) retained by the client for the purpose of photographing the wedding. Family and friends of the clients and other wedding vendors shall not interfere with the photographer’s duties but may take photos at will.
9. PRODUCT DELIVERY
The finished digital files will be provided via an online gallery, within six (6) weeks from the wedding date, unless otherwise agreed. A USB, with a backup of the photos, will also be provided shortly after this. ‘Corinna and Dylan’ is not responsible for any postage times or delays. If the Client requires expedited delivery, they will be responsible for any additional express postage fees. During particularly busy periods and/or holidays delivery time may be delayed.
10. CREATIVE LICENCE
The images delivered will be of a similar style to those on the photographers website. Images are edited at the photographer’s discretion, and the amount of delivered file numbers will vary within the numbers quoted. The style of the images delivered, including the mix of colour and black and white images, is at the discretion of the photographer. No re-editing will be done after the final edited images are presented to the client. The photographer reserves the creative right to edit and release only those images deemed creditable as professional in quality and within the photographer’s artistic standards. The photographer also retains the right to creatively direct the bridal session and all other photographic events.
11. USB STORAGE
Due to the lack of information about how long USBs can hold information, ‘Corinna and Dylan’ recommends you back up your images on another media format other than USB. ‘Corinna and Dylan’ also recommends making multiple copies of USBs every year to ensure the images last for years to come. ‘Corinna and Dylan’ cannot be held responsible for the failure of USBs due to mishandling. It is the client’s responsibility to keep several copies of any USBs in more than one location, and back the images up on another format such as a hard drive.
